Yes – according to the provisions of the Inheritance Act of 1965, or the will.
Are the deceased's children entitled to maintenance from the estate?
Are the parents of the deceased entitled to maintenance from the estate?
Does a person who is entitled to maintenance from the estate have to be an heir according to law or the deceased's will?
No ! For example if the deceased makes a will leaving all his estate to a particular person, his children will not be beneficiaries/heirs. Despite this, as his children they will still be entitled to maintenance from the estate.
