The Need For Probate

When can a beneficiary file for what is due to him under a will?

After probate (an order validating the will) is granted by the Inheritance Registrar or court.

Can probate obtained abroad be enforced in Israel?

No! The process must be started independently in Israel and an Israeli probate order obtained.

Can an instruction in a will be carried out if the beneficiary is dead?

Yes – his heirs will inherit his share so that the instructions can be carried out.

What can be done between the deceased’s death and the actual granting of probate to both protect the estate and rights in it?

The court has discretion to act to this end, and can appoint a temporary executor for the estate to assist in this.
